Preamble

Scalar recognizes the importance of the privacy of visitors and users of all of the websites that Scalar operates (collectively, the “Websites”), including the products and services, such as user-installed instances of the Scalar authoring platform, provided through the Websites (collectively, the “Services”). This Privacy Policy explains the types of information that is collected about you when you visit or use our Websites and Services and how that information may be used. Your access or use of any Website or Service in any way signifies that you have read, understand, and agree to be bound by this Privacy Policy as well as our Terms of Service.

Collection of Information

Scalar collects personally-identifying information from visitors and users of the Websites and Services for a variety of reasons.

In order to access some features of the Websites and Services, including submitting, uploading, posting, or otherwise sharing books and other material or services, you will need to create a Scalar account. If you register and create an account with Scalar, you will be asked to provide personally-identifiable information, including your name and email address. Scalar may also ask visitors or users of Websites or Services to provide personally-identifiable information at other times as specified when the information is requested.

Any information that is submitted, uploaded, posted, or otherwise shared on or through our Websites or Services may become public, including the name and/or email address that you provide when creating an account. For example, the personally-identifiable information of individuals who are contributors of books and other material or services on the Websites may become public, including the name and/or email address that they provide when creating an account.

Scalar automatically creates “access logs” for all individuals who access the Websites or Services. These “access logs” help to make the Websites and Services that Scalar provides more accessible to users. These “access logs” do not involve the collection of any personally-identifiable information, rather they contain information such as the Internet Protocol (IP) address used to access the Scalar Website or Service, information regarding the date and time that you visited the Website or Service, a list of the Content that you downloaded or viewed, and the amount of time that you spent viewing certain Content.

Cookies, Web Beacons, and Other Technologies

Scalar automatically collects information using cookies, web beacons, and other tracking technologies, which help us to provide you with the best experience possible when using our Websites and Services.

You have the option of preventing cookies or web beacons from being set to your hard drive or device, or to clear existing cookies or web beacons from your browser’s or device’s cache. Additionally, you may be able to disable cookies or web beacons in your browser’s preferences, although doing so may prevent you from being able to accommodate certain functionalities on the Scalar Websites or Services.

The use of your personally-identifiable information by Scalar is limited to the following purposes: managing and administering the Websites and Services; responding to messages from users; in connection with books and other material or services that is submitted, uploaded, posted, or otherwise shared on or through our Websites or Services; other internal Scalar purposes; and other purposes specified at the time that the information is gathered.

Scalar may contact users regarding books and other material or services that they submitted, uploaded, posted, or otherwise shared on or through our Websites or Services under certain circumstances.

Information that you provide when submitting, uploading, posting, or otherwise sharing books and other material or services on or through our Websites or Services, such as your name and email address, is likely to become public.

Scalar may also disclose personally-identifiable information when required to do so by law or if Scalar believes that such action is necessary to (a) comply with the law or with legal process, (b) protect against misuse or unauthorized use of the Scalar Websites or Services, or (c) protect the personal safety or property of users of Scalar Websites or Services, the public, or Scalar and its employees.

If you do not want your personally-identifying information to be collected or used for any of the purposes outlined above, please do not provide this information; however, failure to provide this information may prevent you from being able to use certain Scalar
Websites or Services.

You may request the removal of books and other material or services that you submitted, uploaded, posted, or otherwise shared on or through our Websites or Services at any time, and Scalar will take reasonable steps to promptly remove such Content; provided, however, that Scalar can remove any such books and other material or services only from its Websites and cannot remove books and other material or services from email archives, wiki history pages and similar community forums where you may post content, or others’ computers, such as books and material or services you may have sent to others in an email posted to a Scalar email list.

Security of Your Personally-Identifiable Information

Scalar has in place physical, electronic, and managerial safeguards that are designed to protect the privacy of your personally-identifiable information that is collected through its Websites and Services.

Minors Personally-Identifiable Information

In compliance with the Children’s Online Privacy Protection Act, Scalar does not knowingly collect personally identifiable information from individuals under 13 years of age through its Websites or Services. If Scalar becomes aware that it has collected personally-identifiable information from an individual under 13 years of age we will take appropriate steps to remove that information from our database as soon as possible.

You must be over the age of majority in your jurisdiction (which typically is 18 years of age, but may be different in your jurisdiction) and fully competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in the Terms of Services and to abide by and comply with the Terms of Service to register for
an account and use the related Websites and Services; provided, however, that if you are
under the age of majority in your jurisdiction but over 13 years of age, you may join only with the express permission of your parent or legal guardian.

Third-Party Websites and Content; Links

The Websites or Services may contain links to websites not controlled by Scalar (“Third- Party Websites”), as well as material, data, and information belonging to or originating from persons or organizations other than Scalar (“Third-Party Content”). Scalar has no control over, and assumes no liability for, the content, privacy policies, or practices of
any third-party websites. These Third-Party Websites may not have the same Privacy
Policies as Scalar and you should visit their websites, if you wish to view their privacy policies.

Users Outside of the United States

The Websites and Services are controlled and offered by Scalar from its facilities in the United States of America. By vising or using the Website or Service you agree to have your personally-identifiable information used and transmitted to the United States as set forth in this Privacy Policy.

Acceptance of this Privacy Policy and Changes to its Terms

From time-to-time, Scalar may change, remove, add to or otherwise modify this Privacy Policy, and reserves the right to do so in its discretion. If the Privacy Policy is modified, we will post the updated Privacy Policy and indicate the date of revision. We encourage you to periodically review the Privacy Policy. If you do not agree with any modification to the Privacy Policy, you may terminate this agreement by ceasing use of the Websites and Services. Your continued use of any Website or Service after a new and/or revised Privacy Policy is posted indicates that you have read, understood, and agreed to that Privacy Policy.
